General terms and conditions, customer information, and notes on battery disposal

§ 1 Scope, object of contract, and customer identity

(1) The following provisions apply to all contracts between me,

the seller, and you, the buyer, concerning the sale and shipping of products offered in my online shop.

§ 2 Consumers and business customers

(1) My offerings are intended for both consumers and business customers.

(2) A consumer, in this context, is any natural person who concludes a contract with me for purposes not predominantly pertaining to their professional activity in a commercial or freelance context.

(3) A business customer, in this context, is any natural person, legal entity or partnership acting in their professional capacity in a commercial or freelance context when concluding a contract with me.

§ 3 Agreements and information pertaining to the conclusion of contracts

(1) The individual steps leading to the conclusion of a contract, the conclusion of a contract itself, and the rectification options are governed by the following provisions.

(2) The way products are displayed in my online shop does not constitute a legally binding offer but an invitation to place an order.

(3) You place the products you intend to purchase in the shopping basket. You can display the shopping basket and make changes to its contents at any time by clicking on the relevant button in the navigation bar. After calling up the order form, you will enter your personal information and select payment and shipping options. Before submitting your order, you can check all the information you have entered, change it—for this, you can also use the “back” function of your internet browser—or cancel your purchase. If you have completed all steps of the ordering process and then finalize it by clicking on the “purchase” button, you will place a binding order comprising the products listed in the ordering overview. The contract will be concluded as follows, depending on the payment method you have selected (KLARNA, PayPal, or Instore Payment):
In case of KLARNA Payment, you will be redirected to the website of the service provider KLARNA after submitting the order. The contract will be concluded once you provide your information and confirm the payment order.
In case of payment by PayPal, you will be redirected to the website of the service provider PayPal during the ordering process to enter your information and confirm the payment order. After the order has been submitted, I will instruct PayPal to carry out the payment transaction, which results in the conclusion of the contract.
In case of Instore Payment, I will accept your order by way of an e-mail order confirmation. The order confirmation will be sent immediately, no later than 24 hours after receipt of your order.

(4) Order processing and transfer of all information required in the context of the conclusion of the contract is by e-mail. This means that you are obligated to provide me with your correct e-mail address and to ensure the technical requirements for receiving e-mails are met on your end, e.g. e-mails are not blocked by a spam filter.

§ 4 Storage of the text of the contract and contract language

(1) I will not save the entire text of the contract. Before submitting your order, you can electronically store or use your internet browser’s print function to print the contract information. After I have received your order, you will receive an e-mail with the order information and the general terms and conditions including the information legally required for distance contracts.

(2) The language available for the conclusion of the contract is German.

§ 5 Essential characteristics of the goods

The essential characteristics of the goods can be found in the descriptions pertaining to the products on offer.

§ 6 Prices, shipping costs, return costs in case of cancelation, and payment terms

(1) The purchase prices specified on the relevant product pages include the applicable value-added tax.

(2) Each order is subject to additional shipping costs. These costs can be found by clicking on the relevant button in the product description, are listed separately during the ordering process, and are to be borne by you additionally, unless free shipping is offered.

(3) In case of cancelation, you will bear the direct costs of returning the goods.

(4) In case of refusing the shipment, we charge a processing fee of € 6.90, at least the direct costs of returning the goods.

(5) The payment methods available are listed in the product descriptions.

(6) Unless specified otherwise for specific payment methods, the purchase price will be due for immediate payment.

(7) If your purchase is by invoice via PayPal, I will cede my claim for your payment irrevocably and in full to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. You consent to a credit check carried out by PayPal (Europe) S.à r.l. et Cie, S.C.A., using the transferred information to take place before the cession is accepted. I reserve the right to preclude you from using this payment method based on the credit check’s results. You will be informed of this during the purchasing process. If the purchase by invoice via PayPal is cleared, PayPal (Europe) S.à r.l. et Cie, S.C.A., will accept the cession, which means that any debt-discharging payments can only be made to PayPal (Europe) S.à r.l. et Cie, S.C.A. The payment period is 14 days after receipt of the goods.

§ 7 Conditions of delivery

The conditions of delivery, the delivery date, and any applicable delivery restrictions can be found in the product descriptions. If no other period is given in the product description, delivery of the goods is within two weeks after the conclusion of the contract or, in case of payment in advance, after the payment order is placed by you.

§ 8 Warranty

The statutory warranty rights for defects apply.

§ 9 Dispute resolution / ODR platform

(1) The European Commission operates a platform for out-of-court online dispute resolution for consumers (ODR platform) at https://ec.europa.eu/consumers/odr/, which can be consulted by consumers if disputes arise over sale or service contracts concluded by electronic business transaction.

(2) I am neither obligated nor willing to participate in dispute resolutions conducted by a consumer arbitration body.

Notes on battery disposal

By selling batteries or shipping products that contain batteries, I am legally required to inform you of the following:
After use, you can return to me any batteries I carry or have carried free of charge.

As an end user, you are legally required to return old batteries.

The symbols on the batteries have the following meanings:
The crossed-out trash can means that the battery must not be disposed of as regular household waste.

Hg = battery contains more than 0.0005 percent mercury by mass
Cd = battery contains more than 0.002 percent cadmium by mass
Pb = battery contains more than 0.004 percent lead by mass
